This case is calendared for a remote trial at the session of the Court scheduled to commence on November 14, 2022, for cases in which Richmond, Virginia, is the place of trial.
On October 14, 2022, respondent filed a motion to dismiss for lack of prosecution, indicating therein that petitioner's views as to the granting of respondent's motion are unknown.
Upon due consideration of the foregoing, it is
ORDERED that, on or before October 31, 2022, petitioner shall file a response to respondent's motion to dismiss for lack of prosecution filed October 14, 2022. It is further
ORDERED that respondent's motion to dismiss for lack of prosecution filed October 14, 2022, is set for remote hearing on Monday, November 14, 2022, at 10:00 a.m. (EST). Petitioner is advised that failure to comply with this order or failure to appear at the remote hearing on November 14, 2022, may result in the Court granting respondent's motion and entering an order and decision against petitioner. ORDERED that the Clerk of the Court is directed to attach to this order a copy of the notice setting case for trial that was previously issued in this case on July 14, 2022.
