Petitioner, a juvenile, was detained by the trial court pursuant to a detention order and then released. He was then rearrested and detained again without compliance with section 39.044(9), Florida Statutes (1993). We therefore grant the habeas petition and order his release from detention, without prejudice to the trial court to place him again in detention in compliance with section 39.044(9).
