Opinion

March 16, 1999

Appeal from the Civil Court of the City of New York, Kings County (Rolando T. Acosta, J.).

Stamatiki Tsafatinos, appellant pro se.

MEMORANDUM.

Order unanimously affirmed without costs.

A review of the record on appeal indicates that no issues of fact exist warranting a plenary trial. Accordingly, the lower court properly granted defendant Ward's motion for summary judgment.

KASSOFF, P.J. ARONIN and CHETTA, JJ., concur.
