In so far as the essential facts tend to impute liability to defendant, this case presents questions substantially similar to those appearing in Bank v. Bank, ante, 463, and for reasons stated in that case we are of opinion that the judgment of the Superior Court sustaining defendant's demurrer should be

Affirmed.
