Order modified by inserting a provision requiring the respondent to pay all costs of the action up to the time of the granting of the order as a condition of allowing the amendment to the answer; and as modified affirmed, with ten dollars costs and disbursements to the appellant. No opinion. Bartlett, Jenks, Rich and Miller, JJ., concurred.
