This matter comes before the Court on the Report and Recommendation (“R&R”) of United States Magistrate Judge Grady J. Leupold. Dkt. 13. The Court, having reviewed the R&R and any remaining record, and any objections having been filed, hereby finds and ORDERS:
(1) The R&R is ADOPTED.
(2) Plaintiff's Application to Proceed In Forma Pauperis (Dkt. 9) is DENIED, and this case is DISMISSED without prejudice.
(3) The Clerk shall enter JUDGMENT and close this case.
