ORDER
We REINSTATE this appeal.
Before the Court is appellant's April 4, 2017 unopposed motion to extend abatement, or in the alternative, to determine whether the Court has jurisdiction. By order dated March 14, 2017, the Court abated this appeal to allow the trial court to rule on appellee's pending motion to rule on an outstanding claim. We instructed the parties, to file, within thirty days of the date of the order, "a status report informing the Court whether the trial court has ruled on the pending motion and whether this Court has jurisdiction to proceed with the appeal."
In its motion, appellant has informed the Court that appellee's pending motion is set to be heard in the trial court on May 11, 2017. We GRANT appellant's motion to the extent that we ORDER the parties to file a status report, by May 15, 2017, informing the Court of the trial court's ruling and addressing our jurisdiction over the appeal. We further ORDER Felicia Pitre, Dallas County District Clerk, to file, by MAY 22, 2017, a supplemental clerk's record containing the trial court's written order on appellant's pending motion.
We DIRECT the Clerk of this Court to send a copy of this order to the Honorable Tonya Parker, Presiding Judge of the 116th Judicial District Court, Ms. Shirl Townsend, Court Coordinator for the 116th Judicial District Court, Ms. Pitre, and all parties.
We ABATE the appeal to allow the trial court to comply with this order. The appeal will be reinstated in fifty (50) days from the date of this order or when the Court receives the requested status report, whichever occurs sooner.
