VANESSA TREVISO, Appellant v. DISCOVER BANK, Appellee

On Appeal from the 134th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-20-17584

ORDER

BONNIE LEE GOLDSTEIN JUSTICE

Before the Court is appellant's November 7, 2022 motion requesting an extension until January 12, 2023 to file her opening brief. Appellant filed the motion after receiving a notice from this Court dated November 2nd stating her brief was past due. Because it appears the record is incomplete, we DENY the motion as premature. Appellant shall disregard this Court's November 2nd notice.

Although the clerk's record has been filed, the reporter's record has not and is past due. Accordingly, we ORDER Tina Thompson, Official Court Reporter for the 134th Judicial District Court, to file, on or before December 8, 2022, either the reporter's record or written verification that appellant has not requested the reporter's record. Because appellant filed a statement of inability to afford payment of court costs in the trial court, any reporter's record shall be filed without costs. See Tex. R. App. P. 20.1(b)(1). We caution appellant that if we receive written verification of no request, we will order the appeal be submitted without the reporter's record. See id. 37.3(c).

We DIRECT the Clerk of this Court to send a copy of this order to Ms. Thompson and all parties.
