MITCHELL TREVINO, Appellant, v. THE STATE OF TEXAS, Appellee.
Do not publish. Tex.R.App.P. 47.2(b).
On Appeal from the 476th District Court of Hidalgo County, Texas
Before Chief Justice Contreras and Justices Benavides and Silva
ORDER
PER CURIAM.
This cause is before the Court on the court reporter's failure to file the reporter's record. The reporter's record in this matter was originally due on August 6, 2024. After three previous extensions, the reporter's record was due to be filed on November 4, 2024. The Clerk of the Court notified the court reporter, Erika Rodriguez, that no further extensions would be granted absent exigent circumstances. See Tex. R. App. P. 35.3(c).
This Court is tasked with "ensuring the appellate record is timely filed" and "may enter any order necessary to ensure the timely filing of the appellate record." See id. The Court, having fully examined and considered the extensions previously granted in this cause, is of the opinion that, in the interest of justice, the court reporter's fourth request for an extension of time to file the reporter's record should be granted. IT IS THEREFORE ORDERED that court reporter Erika Rodriguez is ordered to file the reporter's record in this Court no later than 5:00 p.m. on December 19, 2024. No further motions for extension of time will be entertained by the Court absent new and exigent circumstances. If the court reporter fails to file the record within the foregoing specified period of time, the Court will act appropriately to avoid further delay and to preserve the parties' rights. See id. R. 37.3 (a)(2).
