ORDER JUDGMENT


For the reasons stated in open court on July 20, 2004, it is hereby ORDERED that the defendants' motion to dismiss the second claim in the plaintiff's amended complaint is GRANTED. Additionally, the plaintiff's motion for additional findings and amendment of judgment is DENIED. This order, together with the Court's order of April 26, 2004, constitute a final judgment in this lawsuit. See Fed.R.Civ.P. 54(a).

SO ORDERED.
