Terry C. TRENTACOSTA, Appellant v. The STATE of Texas, Appellee

From the 399th Judicial District Court, Bexar County, Texas

Trial Court No. 2006CR6469

Honorable Ray Olivarri, Judge Presiding

ORDER

Appellant Terry C. Trentacosta was represented by court-appointed counsel who filed an Anders brief and a motion to withdraw on August 16, 2013. Appellant filed a motion for extension of time to file his pro se brief until November 4, 2013, which this court granted.

Appellant did not timely file a pro se brief. Instead, on November 5, 2013, Appellant filed a "Motion to Withdraw from Filing Pro Se Brief in Response to Counsels Anders Brief" [sic]. In his motion, Appellant prayed that we grant his "Motion To Withdraw From Filing Pro se Brief In Response to Counsels Anders Brief" [sic]. However, Appellant also asserts complaints that could have been included in a pro se brief.

We construe Appellant's motion as asking permission for Appellant to not file any further pro se brief. Appellant's motion is GRANTED. This case will be set for submission based on Appellant's Anders brief, the State's brief waiver letter, and the arguments raised by Appellant in his motion.
