STIPULATION FOR DISMISSAL
WHEREAS, Plaintiffs Travelers Indemnity Company of Illinois and Travelers Property Casualty Company of America (collectively "Travelers") wishes to dismiss without prejudice defendants First Specialty Insurance Corporation. Greenwich Insurance Company, Lexington Insurance Company, National Union Fire Insurance Company of Pittsburgh PA, TIG Insurance Company, Westchester Fire Insurance Company and Clarendon American Insurance Company (collectively the "Carrier Defendants") and re-file against them in state.
WHEREAS, defendant TIG Insurance Company ("TIG") is the only defendant to have appeared in the present action;
WHEREAS, defendant TIG is amenable to Travelers dismissing without prejudice the Carrier Defendants from the present action;
IT IS HEREBY STIPULATED by and between Travelers and TIG, by and through their designated counsel, that defendants First Specialty Insurance Corporation, Greenwich Insurance Company, Lexington Insurance Company, National Union Fire Insurance Company of Pittsburgh PA, TIG Insurance Company, Westchester Fire Insurance Company and Clarendon American Insurance Company are hereby dismissed without prejudice pursuant to FRCP 41(a)(1). TIG further agrees to waive any claim for costs it might have associated with the present action.
