On Appeal from the 116th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-20-03860
ORDER
CORY L. CARLYLE, JUSTICE
Before the Court is appellee's June 21, 2024 unopposed second motion for extension of time to file its brief. Appellee explains the extension is necessary, in part, because the record is incomplete. Specifically, certain documents the parties requested be included in a supplemental clerk's record filed May 2, 2024 were not included in that record.
We GRANT the motion TO THE EXTENT THAT we ORDER appellee to file, no later than June 28, 2024, written verification it has requested a supplemental clerk's record containing the missing documents. We further ORDER Ms. Pitre to file the supplemental clerk's record no later than July 8, 2024.
We note the May 2, 2024 record was filed temporarily under seal pending the trial court's order on a motion to seal under Texas Rule of Civil Procedure 76a. To the extent the trial court has not ruled on the motion to seal by July 8, Ms. Pitre shall file the supplemental record temporarily under seal.
Because the briefing deadline is not triggered until the appellate record is complete, we RESET the deadline for the filing of appellee's brief to twenty days from the filing of the supplemental record.
We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Tonya Parker, Presiding Judge of the 116th Judicial District Court; Ms. Pitre; and the parties.
