Before the Court is appellant's February 27, 2024 second unopposed motion for extension of time to file its brief. Appellant seeks an extension to March 25, 2024, and explains the extension is necessary because certain documents filed under seal in the trial court and not included in the record that has been filed were not retained. Although appellant believes an agreement with appellee as to replacement exhibits is possible, lead counsel for appellee is currently on vacation. Should the parties not reach an agreement, appellant states it will move the trial court for a determination of the issue in accordance with Texas Rule of Appellate Procedure 34.5(e) and 34.6(f).

We GRANT the motion TO THE EXTENT we SUSPEND the brief deadline and ORDER appellant to file a status report as to the missing documents no later than March 11, 2024.

We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Tonya Parker, Presiding Judge of the 116th Judicial District Court, and the parties.
