When this case was called and recalled from the calendar for the Trial Session of the Court at San Francisco, California on November 7, 2022. The parties appeared and were heard. During the trial session counsel for respondent announced that the parties were close to reaching a basis of settlement. Upon due consideration, and for cause more fully appearing in the transcript of the proceeding, it is
