On August 21, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution as to Thu Tran, deceased. This case was called and recalled from the calendar during the Court's September 11, 2023, Philadelphia, Pennsylvania trial session. Petitioner, Tony Tran appeared during the calendar recall and was heard. Respondent appeared and was heard.
Upon due consideration, it is
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution as to Thu Tran, deceased, is taken under advisement. It is further
ORDERED that, on or before October 11, 2023, the parties shall submit a stipulated decision or file a joint status report as to the then-present status of this case. It is further
ORDERED that jurisdiction is retained by the undersigned.
