ORDER OF DISMISSAL

This case is currently calendared for trial on the Court's February 5, 2024, Dallas, Texas trial session. On October 27, 2023, respondent also filed a Motion to Dismiss on Ground of Mootness given that, subsequent to the filing of the Petition, the tax liability for taxable year 2019 has been paid in full by petitioner and the proposed collection action by IRS is no longer necessary. The motion states that petitioner does not object to the dismissal of this case.

Considering the foregoing, it is

ORDERED that this case is stricken for trial from the Court's Dallas, Texas trial session beginning on February 5, 2024. It is further

ORDERED that respondent's Motion to Dismiss on Ground of Mootness filed on October 27, 2023, is granted and this case is dismissed on ground of mootness.
