BILL PEDERSEN, III JUSTICE

Stating they have settled the underlying case, appellants have filed an agreed motion to dismiss the appeal. See Tex. R. App. P. 42.1(a). We grant the motion and dismiss the appeal. See id.

JUDGMENT

In accordance with this Court's opinion of this date, we DISMISS the appeal.

Subject to any agreement among the parties, we ORDER that appellees Calco Land Development, L.L.C. and W. Kenneth Paxton, Jr., recover their costs, if any, of this appeal from appellants Trade Rare, L.L.C. and Byron Curtis Cook.
