ORDER OF SUMMARY REMAND


Defendants Maria Sanchez and David Sanchez, aka Miguel David Gedo filed a notice of removal in an eviction case, in which the Utah Fourth Judicial District Court has entered a default judgment. Defendants' petition to proceed in forma pauperis on the removal was granted.

See Case No. 040401457.

The state case which Defendants seek to remove is not subject to removal under 28 U.S.C. § 1443, as this court does not have subject matter jurisdiction because there is not a federal question raised, there is not complete diversity of citizenship of the parties, and the amount in controversy does not exceed $75,000.

Total amount of the judgment entered in this case is $1,534.50.

IT IS HEREBY ORDERED that this case is summarily remanded pursuant to 28 U.S.C. § 1446(c)(4). A certified copy of this order of remand shall be mailed by the clerk to the clerk of the State Court as provided in 28 U.S.C. § 1447(c).
