Towsley v. State

District Court of Appeal of Florida, Third District
May 28, 1991
579 So. 2d 413 (Fla. Dist. Ct. App. 1991)

Opinion

No. 90-2185.

May 28, 1991.

An Appeal from the Circuit Court of Monroe County; Richard G. Payne, Judge.

Bennett H. Brummer, Public Defender, and Valerie Jonas, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen., and Jacqueline M. Valdespino, Asst. Atty. Gen., for appellee.

Before LEVY, GERSTEN and GODERICH, JJ.

The record reflects an absence of competent evidence to establish that the appellant had an income that was sufficient to enable him to have the ability to pay the costs in question. Accordingly, the order entered by the trial court modifying the appellant's probation must be reversed.

Reversed.
