Townsend v. State

District Court of Appeal of Florida, Second District
Jul 28, 1995
658 So. 2d 651 (Fla. Dist. Ct. App. 1995)

Opinion

No. 94-00751.

July 28, 1995.

Appeal from the Circuit Court for Hillsborough County; Claudia R. Isom, Judge.

Frank Negron, III, Tampa, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Brenda S. Taylor and Stephen D. Ake, Asst. Attys. Gen., Tampa, for appellee.

Steven Alexander Townsend appeals the trial court's denial of his motion to suppress. We affirm the trial court's order denying that motion, but strike the imposition of $150 for costs of prosecution and $20 for the Hillsborough County Court Improvement Fund. See Reyes v. State, 655 So.2d 111 (Fla. 2d DCA 1995).

Affirmed as modified.

FRANK, A.C.J., and ALTENBERND and QUINCE, JJ., concur.
