DECISION & ORDER ON MOTION

Motion by the appellant-respondent for leave to reargue an appeal and a cross appeal from an order and judgment (one paper) of the Supreme Court, Nassau County, entered August 15, 2011, which were determined by decision and order of this Court dated January 16, 2013, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court. Cross motion by the respondent-appellant for the same relief.

Upon the papers filed in support of the motion and cross motion and the papers filed in opposition thereto, it is

ORDERED that the motion and cross motion are denied.
