PLAINTIFFS REQUEST FOR DISMISSAL WITHOUT PREJUDICE


Now come the plaintiffs, hereinabove named, and request that the court dismiss the within action, without prejudice. This request is made because the defendants have entered into a settlement agreement with plaintiffs which, in all likelihood, will obviate any legal action. A portion of the settlement remains to be executed.

WHEREFORE, plaintiffs pray that this action be dismissed forthwith without prejudice.
