PLAINTIFFS' REQUEST FOR DISMISSAL; REQUEST FOR CANCELLATION OF CASE MANAGEMENT CONFERENCE; ORDER


This matter has been settled. Plaintiffs request that the CMC scheduled for October 17, 2003 be cancelled.

Plaintiffs hereby give notice pursuant to FRCP 41(a) that they are voluntarily dismissing the above action with prejudice as to the First and Second Causes of Action. The dismissal of this action is limited in time to the period up to and including the last date when defendants were audited, on or about June 2002. This dismissal does not affect plaintiffs' rights for any time period after that date.

Defendants did not file an Answer in this matter. No cross-complaint has been filed in the action and no other party's consent is required for dismissal.

ORDER

Good cause appearing, the Case Management Conference on October 17, 2003 is canceled and this matter is dismissed.
