ORDER AND JUDGMENT


For the reasons stated in the Court's Memorandum Opinion,

IT IS THEREFORE on this 2nd day of April, 2004, ORDERED that the motion for summary judgment dismissing the complaint pursuant to Federal Rule of Civil Procedure 56 (no. 26-1 on the docket) be and hereby is GRANTED; and

IT IS FURTHER ORDERED AND ADJUDGED that the complaint be and hereby is DISMISSED in its entirety; and

IT IS FURTHER ORDERED that the Clerk of the Court designate the action as CLOSED.
