Jasmine Lorraine Torres Appellant, v. THE STATE OF TEXAS Appellee,
MOTION TO EXTEND TIME FOR THE FILING OF APPELLANT'S BRIEF DUE TO COMPUTER ERROR APPOINTING THE UNDERSIGNED AS COUNSEL
TO THE HONORABLE COURT OF APPEALS:
Attorney Taylor Angel moves this Court to grant Appellant a 60-day extension of time to file Appellant's Brief, and respectfully states:
1. Movant was appointed as Appellant's attorney for cause number CC728794 in Bexar County Court at Law No. 9.
2. At the conclusion of said case, Appellant was placed on probation on 7/19/2024, and notice of appeal was filed on 7/22/2024.
3. After receiving a Notice of Late Brief, Movant met with The Bexar County Managed Assigned Counsel's ("MAC") Resource Attorney and discovered that an appellate attorney was never appointed to this appeal.
4. The MAC's initial assessment is that this error is the result of the Bexar County Criminal Courts transferring their case management data from an older software platform, MOCHA, to Tyler Odyssey on May 30, 2024.
5. Since said transfer, many conversion issues and other problems have arisen with the data that was transferred between the two systems.
6. The MAC will appoint an appellate attorney.
7. This is the first Motion to Extend Time for the Filing of Appellant's Brief.
For these reasons, Movant requests that this Court enter an order extending the time for Appellant to file Appellant's Brief to 60 days from the date of this filing. Movant also requests that Movant be removed from the instant appeal as well as any other relief to which Movant may be entitled.
