ORDER


On April 1, 2002, came on for pretrial conference the above-captioned action. Plaintiff, Yolanda Torres, and defendant, Jay/Gee Corporation, formerly known as Foster Allen, Inc., and Versa Machinery Corporation, appeared by and through their attorneys of record. In accordance with the agreement of plaintiff and defendant and with the rulings of the court,

The court ORDERS that:

(1) plaintiff's claims against defendant be, and are hereby, dismissed with prejudice, each party to bear the court costs incurred by that party; and

(2) defendant's motion for default judgment be, and is hereby, granted and defendant have and recover from third-party defendant, Killion Extruders, Inc., the sum of $27,000.00 and its court costs, plus post-judgment until paid.
