Christopher Luis DEL TORO, Appellant v. The STATE of Texas, Appellee

From the 226th Judicial District Court, Bexar County, Texas Trial Court No. 2022CR5917 Honorable Raymond Angelini, Judge Presiding

ORDER

LIZA A. RODRIGUEZ, JUSTICE

Appellant has filed a motion to compel the district clerk and court reporter to file a complete record, complaining that the warrant and State's Exhibit No. 24 was not included in the appellate record. On October 4, 2024, the court reporter filed a supplemental reporter's record that includes State's Exhibit 24. The clerk's record includes the Affidavit for Search Warrant and Magistration, the Search Warrant, the Order for Assistance in Execution of Search Warrant, the Affidavit of Person Who Withdrew Blood and Nurse's Checklist, and the Police Officer Blood Draw Check List. The trial court clerk has informed this court that the clerk's record is complete. Therefore, appellant's motion to compel is denied as moot.

Appellant has also filed a motion for extension of time. However, as a supplemental reporter's record was filed on October 4, 2024, appellant's brief is not due until November 4, 2024. In his motion, appellant requests an additional thirty days from the date the appellate record is complete. We grant the motion for extension of time and order appellant's brief due on December 5, 2024.
