This case was calendared for trial at the Miami, Florida, Trial Session of the Court commencing on February 27, 2023.
The Court issued an Order served February 14, 2023, staying the proceedings in this case after Mr. Torjman filed a petition in the United States Bankruptcy Court for the Southern District of Florida. Mr. Torjman received an Order of Discharge under 11 U.S.C. § 727 on March 22, 2023, and the bankruptcy court issued a Final Decree on April 24, 2023, discharging the Trustee and closing the case. The Court held a telephone conference with parties on July 19, 2023, to discuss their position on next steps in this case.
Upon due consideration, it is
ORDERED that, on or before September 20, 2023, the parties shall file a proposed stipulated decision, or a joint status report as to the then present status of the case. It is further
ORDERED that the Commissioner's Motion to Dismiss for Failure to Properly Prosecute filed February 6, 2023, is denied without prejudice.
