Topham v. Reitz

Appellate Division of the Supreme Court of New York, Fourth Department
Nov 11, 1942
265 App. Div. 908 (N.Y. App. Div. 1942)

Opinion

November 11, 1942.

Present — Cunningham, Taylor, Dowling, Harris and McCurn, JJ.

Judgment and order reversed on the facts and a new trial granted, with costs to the appellant to abide the event, on the ground that the verdict was inadequate for the damages suffered. All concur, except Taylor and Harris, JJ., who dissent and vote for affirmance. (The judgment is for plaintiff in an automobile negligence action. The order denies plaintiff's motion for a new trial on the ground of inadequacy.)
