The court, on its own motion, modifies the opinion filed herein on November 14, 2002, as follows:

Opinion on page 16, the first sentence in the Disposition [103 Cal.App.4th 788, advance report], the words "and costs" are deleted, so that the sentence now reads:

The order of the trial court awarding Toghia attorney fees is reversed.

This modification changes the judgment.
