MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

This appeal stems from the plaintiff's arrest in Framingham in 2006 which concluded with his pleading guilty to a number of charges.

Suffice it to say that an action for malicious prosecution cannot be maintained when in fact the plaintiff pleaded guilty to the underlying charges. So too, res judicata applies given that the plaintiff unsuccessfully filed similar suits in other jurisdictions arising out of the same conduct now complained of.

We have reviewed all of the claims of the plaintiff and find them to be without merit.

For these reasons, as well as for substantially those in the brief of the defendants, we affirm the judgment.

So ordered.
