Upon consideration, Petitioner, Dexter Brandon Toney's, Request for Rehearing of Order Dismissing Emergency Writ of Habeas Corpus and Request for Immediate Release from Illegal Incarceration for Lack of Subject Matter Jurisdiction is hereby granted. We vacate the order dated January 30, 2015, and substitute the following in its stead:
The Petition for Writ of Habeas Corpus and Request for Immediate Release from Illegal Incarceration is hereby denied.
