Tone v. Tone

Appellate Division of the Supreme Court of New York, First Department
Jun 2, 1966
26 A.D.2d 513 (N.Y. App. Div. 1966)

Opinion

June 2, 1966

Order, entered on March 30, 1966, unanimously affirmed, without costs or disbursements. Our affirmance of the award of temporary alimony is, however, not to have any effect on the Trial Judge in his determination as to permanent alimony, which determination should rest entirely upon the proof adduced at the trial.

Concur — Botein, P.J., McNally, Eager, Steuer and Capozzoli, JJ.
