This case for the redetermination of a deficiency was called on September 9, 2024, and then recalled from the calendar in Dallas, Texas, on September 10, 2024, for hearing on petitioner's motion for continuance, filed August 6, 2024. Petitioner and counsel for respondent appeared and were heard.
The case was set for trial and continued once before upon an unopposed motion made by respondent. According to the motion now before the Court, health reasons have prevented petitioner from appropriately preparing this case for trial or attempting to resolve it without the need for one. Although the parties have made some progress in moving this case forward since it was last scheduled for trial in October 2023, petitioner claims to have additional documents not yet turned over to respondent's counsel that might have consequence to the resolution of this case.
Premises considered, taking into account the representations contained in petitioner's motion, and for cause set forth more fully in the transcript of the above-referenced proceedings, it is
ORDERED that petitioner's motion is granted and this case is continued generally. It is further
ORDERED that as soon as possible, but not later than 60 days before the next scheduled date for trial, petitioner must provide copies of any and all documents that petitioner intends to rely upon in support of any issues remaining in dispute.
Petitioner is advised that the failure to comply with the provisions of this Order could, upon appropriate objection by respondent's counsel, result in exclusion of evidence he offers at trial.
