Conrado A. Tolosa, Jr. & Violeta E. Tolosa, Petitioners v. Commissioner of Internal Revenue, Respondent

ORDER

COURTNEY D. JONES JUDGE.

This case is scheduled for trial at the remote trial session of the Court scheduled to commence at Baltimore, Maryland on November 1, 2021. On October 8, 2021, respondent filed a Status Report and advised that a basis for settlement has been reached. However, the parties require additional time to execute and file the proposed stipulated decision document. Further, on October 11, 2021, petitioners filed two documents titled Reply to Status Report and Memorandum in Support of Reply to Status Report. Collectively, the documents appear to be pages of the same decision document attached to respondent's status report as Exhibit A, only signed by petitioners. Petitioners will need to return the signed decision document to respondent's counsel to be filed after all parties have an opportunity to review and sign it.

Upon due consideration, it is

ORDERED that petitioners' Reply to Status Report (docket entry no. 23) and Memorandum in Support of Reply to Status Report (docket entry no. 24) are hereby deemed stricken from the record. It is further

ORDERED that this case is stricken from the above-referenced trial session, and the parties are excused from appearing at the calendar call on November 1, 2021. It is further

ORDERED that, on or before December 13, 2021, the parties shall electronically file a proposed stipulated decision. It is further

ORDERED that jurisdiction of this case is retained by the undersigned.
