Leave to Appeal Granted April 20, 2000:

The following issues are limited to (1) does MCL 229.1 et seq.; MSA 9.281 et seq., authorize unconstitutional taking of private property for private use, and (2) may the extent of the use sought be considered in determining whether to invoke the statutory procedure. The Attorney General is invited to intervene in the action in the Supreme Court under MCL 14.101; MSA 3.211. The Real Property Law and Public Corporation Law Sections of the State Bar of Michigan are invited to file briefs as amici curiae. Court of Appeals No. 209240.
