On September 17, 2021, respondent filed a Motion to Dismiss for Lack of Prosecution (motion to dismiss). On November 1, 2021, the Court issued an order taking respondent's motion to dismiss under advisement, retained jurisdiction, and directed respondent to file a status report by November 24, 2021. On November 23, 2021, respondent filed a status report stating, among other things, that the parties have reached a basis of settlement that reflects concessions by both parties. Respondent attached to the status report as Exhibit A a copy of the parties' proposed stipulated decision. Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution filed September 17, 2021, is hereby denied. It is further

ORDERED that on or before December 30, 2021, the parties shall submit to the Court a proposed stipulated decision.
