ORDER

Daniel A. Guy, Jr. Special Trial Judge.

On May 24, 2021, petitioner filed a motion to dismiss for failure to properly prosecute as to Intervenor, Jeffry Tobin. Petitioner filed supplements to the motion to dismiss on May 25, May 26, and June 7, 2021.

This case was called at the Court's June 14, 2021, Syracuse, New York remote trial session. All parties appeared and were heard on the motion to dismiss.

After due consideration and for cause more fully appearing in the transcripts of the proceeding, it is, ORDERED that petitioner's motion to dismiss for failure to properly prosecute, as supplemented, is denied.
