Opinion

Case No. 96-1034

Opinion filed August 13, 1997

Appeal from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Ronald V. Alvarez, Judge; L.T. Case No. CJ-95-6889-JK.

Richard L. Jorandby, Public Defender, and Ian Seldin, Assistant Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Aubin Wade Robinson, Assistant Attorney General, West Palm Beach, for appellee.

We affirm appellant's conviction but remand to the trial court for the entry of a new disposition order which correctly indicates that appellant was convicted of simple battery and not aggravated battery.

DELL, GUNTHER and GROSS, JJ., concur.
