JUDGMENT


In accordance with the order entered on this date, it is hereby ORDERED, ADJUDGED, and DECREED that judgment be entered in favor of respondent Ralph Hooks and respondent Attorney General of Alabama and against petitioner Michael Andrew Tippitt on all claims.

ORDER

After due and proper consideration of all pleadings in this file, and a de novo determination of those portions of the Report and Recommendation to which objection is made, the Report and Recommendation of the Magistrate Judge made under 28 U.S.C. § 636 (b)(1)(B) is ADOPTED as the opinion of the court.

It is ORDERED that this habeas petition is DENTED and this action DISMISSED.
