RULING ON PLAINTIFF'S MOTION FOR ADDITUR


A hearing was held on the motion for additur on July 23, 2007. At the hearing counsel for the parties presented oral argument and made reference to their written briefs previously submitted.

The Court has considered the entire record of the proceeding including the evidence presented at trial. The jury evaluated evidence on many disputed questions of fact and awarded damages. There is no evidence to suggest that the jury was influenced by partiality, mistake or corruption. Further the Court finds that the verdict does not manifest an injustice nor is it contrary to a reasonable evaluation of the evidence. See generally: Lombardi v. Cobb, 99 Conn.App. 705 (2007). Accordingly the motion for additur is denied.

SO ORDERED.
