ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on October 17, 2002, the court determines that the findings and conclusions of the United States Magistrate Judge are correct. The findings and conclusions of the United States Magistrate Judge are hereby accepted as those of the court. The court denies Jeffrey Todd Tinsley's petition for Writ of Habeas Corpus relief for failure to exhaust state remedies and dismisses this action without prejudice. It is so ordered.

In light of the court's dismissal of this claim, it need not address Petitioner's request to dismiss Respondents Janie Cockrell and the Texas Department of Criminal Justice, Institutional Division.
