ORDER DENYING MOTION FOR PRELIMINARY INJUNCTION


For the reasons stated in open court on August 24, 2001, IT IS HEREBY ORDERED that plaintiffs' motion for a preliminary injunction is DENIED.

As I stated during the hearing, IT IS FURTHER ORDERED that:

1.) defendant shall maintain records such that it can identify every California consumer who seeks to resolve a dispute informally from August 1, 2001, the effective date of the Consumer Service Agreement, until the matter is resolved;

2.) within five (5) court days of being advised that a California consumer has sought arbitration pursuant to paragraph 7.b, defendant shall notify the court and plaintiff's counsel of the arbitration request. The court will then consider whether a further order is necessary or appropriate with respect to that arbitration; and

3.) a case management conference is scheduled for 10:30 a.m. on Wednesday, August 29, 2001. Any party wishing to appear telephonically shall make arrangements prior to the conference by contacting my courtroom deputy, Lashanda Scott, at (415) 522-2015.
