765 So. 2d 852 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D00-2474

Opinion filed August 16, 2000 JULY TERM 2000 Rehearing Denied September 25, 2000.

Appeal of order denying rule 3.850 motion from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; Hubert R. Lindsey, Judge; L.T. Case No. 96-5897CFC02.

Demetrius Timms, Miami, pro se.

No appearance required for appellee.

We affirm the trial court's denial of appellant's motion for post-conviction relief. See Battle v. State, No. 4D99-3144 (Fla. 4th DCA June 28, 2000). This affirmance is without prejudice for appellant to seek administrative relief on the issue of his gain time claim. See Clements v. State, No. 2D00-2309 (Fla. 2nd DCA July 12, 2000).

KLEIN, SHAHOOD and GROSS, JJ., concur.
