We affirm the judgment in favor of appellees but reverse the award of attorney's fees which were awarded under the provisions of Rule 1.442, Florida Rules of Civil Procedure. See Timmons v. Combs, 608 So.2d 1 (Fla. 1992).

REVERSED and REMANDED for determination of taxable costs.
