Appeal dismissed, without costs, by the Court of Appeals sua sponte upon the ground that the order appealed from does not finally determine the action within the meaning of the Constitution. To the extent that Marco v Sachs ( 10 N.Y.2d 542) would seem to suggest a contrary result, it is not to be followed (see Cohen and Karger, Powers of the New York Court of Appeals, § 36, subd [b], p 143).
