Appellants Jann E. Thompson and Daniel Louis Thompson appealed a judgment entered by the 135th District Court of Refugio County, Texas.
By an order dated December 17, 2015, the Court determined that appellants were obligated to pay the $205.00 filing fee because the trial court's order that sustained a challenge to appellants' affidavit of indigence had become final. We directed appellants to pay the fee before the expiration of thirty days from the date of the order or the Court would dismiss the appeal. See TEX. R. APP. P. 42.3(c). By an order dated January 14, 2016, we denied appellants' "Motion to Grant Exchange of Obligation or Other Security," in which they appeared to ask this Court to accept the filing fee in a form other than U.S. currency. Thirty days from the date of our December 17th order was January 19, 2016. Appellants have attempted to pay the $205.00 filing fee with a document labeled an "International Bill of Exchange" that they enclosed in a letter dated January 14, 2015. However, appellants have not tendered any form of U.S. currency to the Court. See TEX. R. APP. P. 5, 12.1(b).
The Court, having considered the documents on file and appellant's failure to pay the filing fee, is of the opinion that the appeal should be dismissed. See id. 42.3(b), (c). Accordingly, the appeal is DISMISSED for want of prosecution.
IT IS SO ORDERED.
PER CURIAM Delivered and filed the 4th day of February, 2016.
