ORDER


On May 21, 2003, Plaintiff's Motion to Take the Deposition of Orla Beth Peck and Plaintiff's Motion in Limine or in the Alternative for Leave to Amend the Complaint to Join Cuna/Cumis as Parties was heard by Magistrate Judge Alba in the above-entitled matter. Present and representing plaintiff was Martha Knudson and George T. Naegle of Richards Brandt Miller Nelson. Present and representing defendant was Richard Barnes of Paul Matthews Associates.

The court, having heard oral argument on defendant's motion, having reviewed the pleadings and exhibits, and good cause appearing therefor, the court orders as follows:

1. Plaintiff's motion to take the deposition of Orla Beth Peck is granted;

2. Plaintiff's motion to amend his complaint is granted;

3. The court's ruling on plaintiff's motion in limine denied at this time.
