TRACEY B. THOMPSON, Appellant v. MARTIN F. GAINES, Appellee
On Appeal from the 101st Judicial District Court Dallas County, Texas Trial Court Cause No. DC-19-09781
ORDER
CRAIG SMITH, JUSTICE
On April 4, 2022, after appellant failed to comply with our directive of providing written verification she had requested the reporter's record, we ordered the appeal submitted without that record and directed appellant to file her brief by May 4, 2022. Rather than filing the brief, appellant has filed a motion informing the Court she requested the reporter's record on April 9 and requesting an extension of time to file her brief.
We GRANT the motion and VACATE our April 4th order. Because the reporter's record has not yet been filed, we ORDER Terri Etekochay, Official Court Reporter for the 101st Judicial District Court, to file the record no later than June 3, 2022. The record shall be filed without payment of the reporter's fee as the clerk's record includes a copy of appellant's statement of inability to pay and nothing before us reflects appellant has been ordered to pay costs. See Tex. R. Civ. P. 145.
Appellant's brief shall be filed within thirty days of the filing of the reporter's record.
We DIRECT the Clerk of the Court to send a copy of this order to Ms. Etekochay and the parties.
